Real Time eXecutives, Inc. warrants that each software program furnished to the Customer will be in good working order for a period of ninety (90) days from the date of e-mailing the license code. Real Time eXecutives, Inc. entire liability and Customer's exclusive remedy shall be, at Real Time eXecutives, Inc. option, either the return of the purchase price or replacement of the software program that does not meet Real Time eXecutives, Inc. "Limited Warranty". If failure has resulted from accident, abuse, misuse, misapplication, or use on defective or non-compatible equipment, Real Time eXecutives, Inc. shall have no responsibility to replace the software program or refund the purchase price. Any replacement will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. Real Time eXecutives, Inc. does not warrant that the software programs will meet Customer requirements or operate in the combinations Customer may select for use, or that the operation of the software programs will be uninterrupted or error-free.

EXCEPT AS EXPRESSLY PROVIDED IN THE LIMITED WARRANTY ABOVE, THE LICENSE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
